If you are considering holding a tabletop sale, a fete, car boot
sale or something similar, it may be that your event constitutes at
law, a market. In such cases, you are required to obtain consent
from Council Markets Authority. |

|
|
In
essence, it is unlawful for anyone to hold a market, even upon land
which is in their ownership, without the Council’s specific consent.
This is because Calderdale Council has the sole and exclusive right
to hold markets (defined in law as a concourse of buyers and
sellers) within a specified area of 6.2/3 miles from the nearest
established Council market. |

It is not our
intention to prevent other events taking place, but to ensure that
the Council’s rights to operate markets are upheld and all market
type events are registered with the Authority and regulated, unless
they are deemed to cause a nuisance to the events operated by the
Council. |

We grant a temporary
market licence to hold a market for charitable/fundraising purposes.
Before we grant such a licence, we require you to fill in an
application form for a licence detailing your event and return
it to us at Calderdale Markets, 19 Albion Street, Halifax HX1 1DU,
at least six weeks before your event. |

|
|
We need the details of
your event in order to determine what the category of your event is
and if it is deemed at law a rival market to one of those operated
by the Borough Council. |
|
|
|
If it is
determined that your event is not a market then you will not require
consent nor will a charge be levied |

It should be noted that large car
boot sales are more likely to cause environmental damage e.g. litter
and create a nuisance for the community. Responsibility for
enforcing standards lies with the police or personal claims against
the organisers. |
